To the maximum extent permitted by applicable law, Koboy89 shall not be liable to any Member for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Platform, including but not limited to: loss of winings, loss of profits, loss of data, or interruption of service.
Koboy89 does not warrant that the Platform will operate uninterrupted, error-free, or free from technical defects. The Platform is provided on an "as is" and "as available" basis. Koboy89 makes no representations or warranties — express or implied — regarding the fitness of the Platform for any particular purpose.
In circumstances where Koboy89 is found liable for direct damages, the maximum aggregate liability shall not exceed the total net deposits made by the affected Member to the Platform in the twelve (12) calendar months immediately preceding the event giving rise to the claim.

Upon termination of a Member's Account, any real-money Balance (net of Bonus Funds that have not met applicable wagering requirements) shall be returned to the Member via their last verified payment method, subject to completion of outstanding KYC obligations.
